Please read these terms carefully as they affect your rights and liabilities under the law.

If you do not agree to these Terms of Use, please do not subscribe as a Client, use the Website, or purchase any of the products or services.

Introduction

These terms and conditions apply between you, the Client (including the use of this website, any sub-domains -unless expressly excluded by their own terms and conditions- and online platforms related to this business), and Alonso Lizaraz, the owner and operator of this Website and any 3rd party online platform related to the business as Lizaraz Fitness & Health.

Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website and any 3rd party online platforms related to the business. If you do not agree to be bound by these terms and conditions, you should stop using the Website or any 3rd party online platforms related to the business.

In these terms and conditions, Client, User or Users means any third party that accesses the Website or any 3rd party online platforms related to the business and is not either (i) employed by Alonso Lizaraz and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Alonso Lizaraz and accessing the Website or any other online platform in connection with the provision of such services.

You must be at least 18 years of age to use this Website. By using the Website or any other online platform and agreeing to these terms and conditions, you represent and warrant that you are at least 18 years of age.

Medical

At the point of purchasing a service from Alonso Lizaraz you’ll be provided with an online PAR-Q (Physical Activity Readiness Questionnaire) to assess your general physical health.

Alonso Lizaraz is not a medical practitioner or a registered dietitian. It is strongly recommended that prior to commencing any diet or exercise regime that you consult a medical practitioner and/or registered dietitian first.

Alonso Lizaraz has no expertise in treating medical conditions of any kind, or in determining the effect of any specific exercise or diet on a medical condition.

You acknowledge that when participating in any exercise or exercise program that there is the possibility of physical injury.

Signing up on a Direct Debit plan

Upon signing up on a Subscription plan (Star, Hero, Legend, Online Coaching) you must ensure that the details provided or at any time are correct and complete. You must inform immediately through any means provided of any changes to the information that you consent to give when signing up by updating your personal details to ensure communication with you is effective. Your subscription could be suspended or cancelled with immediate effect for any reasonable purposes or if you breach these terms and conditions.

By signing up to any Subscription plan you commit to a minimum of 3 full months before any cancellation of sessions or payments can be made.

All Subscription sessions must be used within the calendar month. Any sessions not used within the calendar month will be lost and may not be carried over into the following months.

Additional sessions are available at the same rate of the active Subscription and will be processed via online invoice for the total amount of sessions required withing a calendar month.

Payment will be taken on the 1st day of the month.

Cancellation of a Subscription

If you have completed 3 full months of a Subscription and you chose to finish your sessions after the initial period ends, you must put this in writing through the channels provided with one full calendar month notice.

Training packs

Training packs must be paid in full before the start of the sessions. Payments can be made through online invoice or direct bank transfer.

You will receive a customer receipt for any payment of sessions you make.

All training packs have a 90 day expiry, after which time any unused sessions will be lost and no refund will be made. 

You may extend training packs for between 1 month and 12 full calendar months for the following reasons only:
– Pregnancy
– Serious illness
– Serious injury
– Redundancy

To extend your training pack you must contact Alonso Lizaraz through the channels provided. Alonso Lizaraz may ask you for proof of pregnancy, illness, injury or redundancy. 

Any other extensions are at the discretion of Alonso Lizaraz.

Refund Policy and Session Cancellations

These are explained on the Client Agreement document

Promotions, coupon codes and gifts

When a promotion, coupon code or gift is offered, their use is restricted to one per new client.

Coupon codes are limited to one per transaction unless the coupons apply to different products.

Coupon codes cannot be used in conjunction for the same product.

Once a discounted training pack has come to an end it will go back to regular price.

All promotions, coupon codes and gifts can be withdrawn at any given time without notice.

Expected Results

While Alonso Lizaraz believes that for most people, following his programmes and methods will lead to desired results, all exercise programmes depend on the individual. Results will be affected by the effort and commitment of the individual, however in some circumstances even where an individual follows Alonso Lizaraz’ programme, they may not achieve the desired results. Alonso Lizaraz therefore provide no warranties of any kind, express or implied, as to:

The effectiveness of any techniques, diets or programmes that Alonso Lizaraz deliver; or

The results that you may achieve as a result of following Alonso Lizaraz’ programs.

All testimonials shown on Lizaraz Fitness and Health channels are real people who have followed the plans provided by Alonso Lizaraz. For the avoidance of any doubt, however, they are not indicative of the results that you are likely to achieve, rather they are included as examples of the results that particular individuals have achieved.

Intellectual property and acceptable use

By providing any content for distribution (such as before and after photographs) you expressly grant a worldwide, royalty-free, perpetual, irrevocable licence to use, copy, store, perform, display and distribute such content.

All Content included on the Website or any 3rd party online platform, unless uploaded by Users, is the property of Alonso Lizaraz, affiliates or other relevant third parties. In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users. By continuing to use the Website or any 3rd party online platform you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner’s prior written permission.

You may, for your own personal, non-commercial use only, do the following:

Where we provide you with a Personal Plan, the information contained therein should not be regarded as or relied upon as being a comprehensive health or exercise programme. Accordingly, any actions that you take in relation to a Personal Plan should not be pursued regardless or to the exclusion of other information, opinions or judgments that are available to you.

Any Personal Plan, Personal Training or nutrition-related service will have been prepared on the basis of information provided by you in the PAR-Q (Physical Activity Readiness Questionnaire). You are responsible for the accuracy of any information that you provide. You are responsible for informing of any health issues or medical conditions when asking to prepare a Personal Plan, Personal Training or nutrition-related service.

Before taking any action in relation to a Personal Plan, you must take into account any other factors apart from the Personal Plan of which you are or ought to be aware.

The information set out in any Personal Plan may relate to certain contexts and may not be suitable in other contexts. It is your responsibility to ensure that you do not use the information provided in the wrong context.

You are responsible for informing of any health issues and pre-existing medical conditions when you ask to prepare a Personal Plan, Personal Training ore nutrition-related service.

Any information provided that does not form part of a Personal Plan, Personal Training or nutrition-related service, whether obtained through our website, e-book, video course, social media (such as Facebook, Instagram, Twitter or Linkedin) or otherwise, is provided for the purposes of general information only.

You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.
